The ‘My Territorial Garden Contest’ is sponsored by Territorial Seed Company. This contest is governed by these Official Rules. By participating in the contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the contest, as determined by Territorial Seed Company, are final in all respects. The contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.
This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Any questions, comments or complaints regarding the promotion will be directed to Territorial Seed Company, not Facebook.
ELIGIBILITY
The contest is open to legal residents of the United States, who are eighteen (18) years of age or older at the time of entry who have Internet access and a valid e-mail account prior to the beginning of the Contest Period. Territorial Seed Company employees, immediate relatives or those living in the same household as Territorial Seed Company employees are not permitted to enter the contest. Territorial Seed Company has the right to verify the eligibility of each entrant.
CONTEST SUBMISSION PERIOD
The contest begins Friday, August 28, 2020 and ends at 11:59pm Pacific Time on Friday, September 18th, 2020. All entries must be received on or before the time stated during that submission period. Territorial Seed Company reserves the right to extend or shorten the contest at their sole discretion.
HOW TO ENTER
You can enter the contest through Territorial Seed Company’s Facebook or Instagram Page. After submitting the required information, the entrant will receive one (1) entry.
Only one entry per household.
PHOTO SUBMISSION
Winners will be asked to submit an original, high resolution, digital file. Territorial Seed Company reserves the right to disqualify incomplete entries and/or contestants who are unable to submit, upon request, a high-resolution photo.
You as the photographer are the copyright holder and you retain your rights to your photograph. For winning photographs you grant Territorial Seed Company a royalty-free license to publicly display, distribute, reproduce and create derivative works of the entries, in whole or in part, in any media now existing or later developed, for any Territorial Seed Company purpose.
Basic editing, including color enhancement, the use of filters, and cropping of the photo is acceptable, provided any such editing does not affect the authenticity and/or genuineness of the photo.
Photos that portray or otherwise include inappropriate and/or offensive content, including nudity, violence, human rights and/or environmental violation, and/or any other contents deemed inappropriate by Territorial Seed Company are strictly prohibited and will be immediately discarded.
Submitted photos must be original, created and/or taken by the contestant. It must not contain any materials owned or controlled by a third party for which you have not obtained a license, must not infringe the copyright, trademark, moral rights, rights of privacy/publicity or intellectual property rights of any person or entity.
WINNER SELECTION
All eligible entries received during the Submission Period will be collected and three (3) winner will be chosen by Territorial Seed Company staff. The winners will be contacted via email or private message on social media before announced publicly. Winners will be selected during the week of September 20th, 2020 and contacted after all winners have been chosen. Each entrant is responsible for monitoring their email or social media account for prize notification and receipt or other communications related to this contest. If a potential prize winner cannot be reached by Territorial Seed Company within fifteen (15) days, using the contact information provided at the time of entry, or if the prize is returned as undeliverable, that potential prize winner shall forfeit the prize. Upon the request of Territorial Seed Company, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 form. If a potential winner fails to comply with these official rules, that potential winner will be disqualified. Prizes may not be awarded if an insufficient number of eligible entries are received.
PRIZES:
First (1st) place will receive a $100 Territorial Seed Company Gift Card and will have their garden photo featured in our 2021 Spring Catalog and across our social media. Second (2nd) place will receive a $50 Territorial Seed Company Gift Card and will have their garden photo featured across our social media. Third (3rd) place will receive a $25 Territorial Seed Company Gift Card and will have their garden photo featured across our social media.
PRIVACY & PUBLICITY
By participating, each entrant grants Territorial Seed Company’s permission to use their name, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law. We will not share personal mailing addresses or email addresses; that information is collected for the sole purpose of contacting the winner and distribution of the prize.
ADDITIONAL LIMITATIONS
Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible for any typographical or other errors in the offer or administration of the contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this contest is unlawful and subject to possible legal action by Territorial Seed Company. Territorial Seed Company reserves the right to terminate, suspend or amend the contest, without notice, and for any reason, including, without limitation, if Territorial Seed Company determines that the contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Territorial Seed Company’s control corrupt the administration, security, fairness, integrity or proper play of the contest. In the event any tampering or unauthorized intervention may have occurred, Territorial Seed Company reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE WINNER.
INDEMNIFICATION AND LIMITATION OF LIABILITY
BY ENTERING THE CONTEST, EACH ENTRANT AGREES TO INDEMNIFY, RELEASE AND HOLD HARMLESS TERRITORIAL SEED COMPANY AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES, THE FACEBOOK PLATFORM, ADMINISTRATOR, ADVERTISING AND PROMOTIONAL AGENCIES, AND ALL THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS FROM ANY LIABILITY, DAMAGES, LOSSES OR INJURY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM THAT ENTRANT’S PARTICIPATION IN THE CONTEST AND THE ACCEPTANCE, USE OR MISUSE OF ANY PRIZE THAT MAY BE WON. TERRITORIAL SEED COMPANY AND ITS PARENT, AFFILIATE AND SUBSIDIARY COMPANIES DO NOT MAKE ANY WARRANTIES, EXPRESS OR IMPLIED, AS TO THE CONDITION, FITNESS OR MERCHANTABILITY OF THE PRIZE.
